1. Acceptance of Terms

By accessing or using MotionNova, you agree to these Terms of Service, our Privacy Policy, Refund Policy, and other rules displayed on the website. If you do not agree, do not use the service.

MotionNova is operated by MotionNova Team, doing business as MotionNova. The operating country/region and identity details are maintained consistently with Creem merchant review records; support: support@motionnova.app.

2. Service Description

MotionNova is an independent AI video ads generation SaaS that provides text-to-video, image-to-video, Reference to Video, generation history, credits, and subscription features. We process generation requests through third-party AI models, APIs, compute resources, and storage services; third-party names are used only to describe supported capabilities and do not imply resale, official partnership, or authorized representative status. Generation time, availability, and output quality may vary based on request content, model status, or third-party service status.

3. Accounts and Security

You must provide accurate account information and are responsible for protecting your login methods, email address, and account activity. If you notice unauthorized use, contact us at support@motionnova.app.

4. Subscriptions, Payments, and Renewals

Paid plans, prices, credit amounts, and billing periods are shown on the Pricing page or checkout page. Subscription plans renew automatically for the selected billing period until canceled. One-time credit packs are granted according to the details shown at purchase. For purchases processed through Creem, Creem acts as the Merchant of Record and handles payment processing, taxes, invoices, and related payment support. MotionNova does not store full card details.

5. Subscription Cancellation

You may cancel your subscription at any time through the billing area in account settings or by contacting support@motionnova.app for assistance. After cancellation, subscription access generally remains available until the end of the current paid period, and no further renewal will be charged. Cancellation does not automatically refund prior payments; refund requests are handled under our Refund Policy.

6. Credits and Generation Tasks

Video generation consumes credits. Once a task starts processing, AI compute resources may be consumed. If a task fails due to a verifiable technical issue on MotionNova's side, we may release credits, retry processing, or provide another reasonable remedy. Free, promotional, or expired credits may have additional limitations.

7. User Content and Generated Content Rights

You retain ownership of prompts, images, audio, videos, and other materials you submit. You grant MotionNova and necessary third-party service providers a limited license to host, process, transmit, store, and generate your requests. You must ensure submitted materials are lawful to use and do not infringe third-party rights, likeness/publicity rights, trademarks, copyrights, or confidentiality obligations. Subject to these Terms, our Acceptable Use Policy, payment of applicable fees, and compliance with applicable law, you may use videos generated through MotionNova, including for commercial purposes. AI outputs may not be unique, other users may generate similar content, and we do not guarantee that outputs are fully accurate, exclusive, non-infringing, or suitable for a particular purpose.

8. Prohibited Uses

You may not use MotionNova to create or distribute illegal, infringing, fraudulent, hateful, harassing, explicit sexual, unauthorized deepfake, face swap, impersonation, non-consensual likeness, materially misleading, fake news, malware-related, political manipulation, fake review, fake traffic, or otherwise harmful content. Additional restrictions are described in our Acceptable Use Policy. We may refuse, suspend, or terminate accounts or tasks that violate these Terms, our Acceptable Use Policy, or our payment provider's acceptable use policies.

9. Unofficial Product Notice

MotionNova is an independent AI video ads generation service. It is not an official product, authorized representative, partner, or affiliate of ByteDance, Seedance, Kie.ai, Evolink, or any third-party AI model, platform, or brand. All third-party names, trademarks, model names, and brands belong to their respective owners and are used only to describe compatibility or service capabilities.

10. Disclaimers and Availability

MotionNova is provided on an "as is" and "as available" basis. We work to keep the service reliable, but we do not guarantee uninterrupted service, error-free operation, outputs that perfectly match expectations, or constant availability of third-party services.

11. Limitation of Liability

To the fullest extent permitted by law, MotionNova will not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, business opportunities, or reputation.

12. Abuse and Termination

If we believe an account is involved in abuse, fraud, infringement, payment risk, restriction circumvention, or violation of these Terms, we may limit generation, remove content, suspend or terminate the account, and refuse future service. Consumed compute resources and charges caused by violations are generally non-refundable.
